Terms of Service

These terms are an agreement between you and American Productivity Company (“we”, “us”). They cover the Attention app, Attention Cloud, and this website (together, “Attention”). By downloading or using Attention, you agree to them. If you use Attention for an organization, you agree on its behalf and confirm you are allowed to.

Attention is in beta

Attention is beta software. Features may change, break, or go away, and we may lose or mis-sync data. Keep your own copies of anything important. Your original messages, mail, and calendars stay with the services that host them.

The app and its license

We grant you a personal, non-exclusive, revocable license to install and use the Attention app. Where we publish Attention’s source code under an open-source license, that license governs your use of the code, and nothing in these terms limits the rights it gives you. Our name, logo, and brand are not licensed to you.

Your accounts and connected services

• You may only connect accounts you are allowed to use. You are responsible for activity on your Attention account and for keeping your Mac and credentials secure.
• When you connect a service — Google, iMessage, LinkedIn, WhatsApp, or any other — you authorize Attention to access it on your behalf. Your use of that service is still governed by its own terms.
• Some services connect through third-party providers. Those services can limit, change, or end access at any time, and we are not responsible for that.

AI features and the agent

• AI features and the agent are optional. AI output can be wrong, incomplete, or inappropriate. Review it before you rely on it.
• You are responsible for the messages sent and actions taken from your account. That includes ones the agent drafted and you approved, and ones run by a rule you approved.
• When you use your own API key or AI subscription, your use of that provider is governed by your agreement with it, including its charges.

Acceptable use

Don’t use Attention to:

• break the law or violate anyone’s rights
• send spam or unsolicited bulk messages
• harass, threaten, or impersonate anyone
• break the terms or rate limits of a connected service (for example, automated outreach a platform forbids)
• access accounts or data you aren’t authorized to access, or interfere with Attention Cloud or other people’s use of it

We may suspend or end access to Attention Cloud for anyone who breaks these rules.

Your content

Your messages, notes, and other content remain yours. You give us permission to store, process, and transmit them only as needed to run Attention for you, as described in our Privacy Policy. Content you share to a workspace is visible to its members.

Attention Cloud and pricing

The Attention app is free to run on your Mac. Attention Cloud is optional and currently free during the beta. Prices on this site are what we intend to charge. Nothing is billed today. Before any paid plan starts, we will show you its price and terms, and you will have to agree to them.

Feedback

If you send us ideas or feedback, we may use them without any obligation to you.

Ending use

You can stop using Attention at any time. Delete the app to remove its local data, and email us to delete your Attention Cloud account. We may suspend or end Attention Cloud if you break these terms or if we discontinue the service. When we discontinue it, we will try to give you notice and a chance to export your data.

No warranty

Attention is provided “as is” and “as available”, without warranties of any kind, express or implied. That includes merchantability, fitness for a particular purpose, non-infringement, and that it will be uninterrupted or error-free. Some places don’t allow excluding certain warranties, so some of this may not apply to you.

Limitation of liability

To the fullest extent the law allows, American Productivity Company is not liable for indirect, incidental, special, consequential, or punitive damages. That includes lost data, lost profits, or messages sent or not sent. Our total liability for any claim about Attention is limited to the greater of the amount you paid us in the 12 months before the claim, or US$100.

Indemnity

If someone makes a claim against us because of how you used Attention or because you broke these terms, you agree to cover our reasonable costs of that claim, to the extent the law allows.

Changes to these terms

We may update these terms. We’ll change the date at the top, and for material changes we’ll give notice in the app or by email before they take effect. Continuing to use Attention after that means you accept the new terms.
